"read before you post" question.

I was reading the sampling "Read before you post" sticky for this Sampling forum (Since I got a warning for breaking a posting rule, I figured I should probably read them) and I came across the part that says it is copyright infringement to use other artists samples without permission. Now, I already know that, but not minute specifics. I was wondering if this is applicable to ALL samples. For example, if say, Kanye puts out a new song and you sample the hook, that's blatant infringement, no? On the other side, if you download a pack of drum samples to build a midi-kit for a project, does this also count as infringement? Is it dependent on a disclaimer from the host site? My main question is, if I used a kick, snare, tom, and cymbal sample (not from any specific production that I know of, as I mentioned earlier in my Kanye example... But more like, purposely recorded samples for the purpose of putting drum sounds to a midi track), am I liable to get sued for it moving forward?
